Welcome to Bird Identifier ("we," "us," or "our"). By downloading, accessing, or using the Bird Identifier mobile application, website, or related services (collectively, the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please refrain from using the App.

1. Use of the App

Bird Identifier provides AI-powered bird species recognition, educational content, and community features. You must be at least 13 years old to use the App. You agree to use the App only for lawful purposes and in accordance with these Terms. You shall not misuse the identification tools, upload harmful content, or attempt to reverse-engineer our AI models.

2. Account & Privacy

Certain features may allow account creation. You are responsible for maintaining the confidentiality of your login credentials. Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the data practices described in the Privacy Policy.

3. User-Generated Content & Bird Observations

You may upload photos, bird sightings, and comments. You retain ownership of your content, but grant Bird Identifier a non-exclusive, royalty-free license to use, analyze, and display that content to provide identification services and improve algorithms. We respect copyright – do not upload images you do not have permission to share.

4. Intellectual Property Rights

All trademarks, logos, interface design, and underlying AI models are property of Bird Identifier or its licensors. You may not copy, modify, or distribute any part of the App without prior written consent. However, you may share bird identification results for personal, non-commercial purposes.

5. Disclaimer of Warranties

The App is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for accurate bird identification, we do not guarantee 100% accuracy. Bird Identifier disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Always verify critical identifications with expert sources.

6. Limitation of Liability

To the maximum extent permitted by law, Bird Identifier and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, bird misidentification, or any personal injury arising from use of the App. Our total liability shall not exceed the amount you paid (if any) to access the App.

7. Termination

We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time. Upon termination, certain provisions (disclaimers, limitations of liability) shall survive.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. If changes are material, we will notify you via in-app notice or email. Continued use after the effective date means you accept the revised Terms.

9. Governing Law

These Terms shall be governed by the laws of Pakistan, without regard to conflict of law principles. Any disputes arising from the App shall be resolved exclusively in the courts located in Pakistan.
